This Privacy Policy explains how PropWisdom collects, uses, stores and protects personal information about clients, prospective clients and their related parties while providing buyers agency services.
It applies to PropWisdom staff and contractors working on client files and reflects PropWisdom's obligations under the Privacy Act 1988 (Cth), the NSW Property and Stock Agents Act 2002, and the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF Act), including applicable customer due diligence and record-keeping obligations.
Depending on the services required and the circumstances of a purchase, we may collect:
We collect this directly from clients wherever possible and only what is reasonably necessary to provide buyers agency services and meet applicable legal obligations.
We use client information to identify and assess suitable properties, conduct due diligence, communicate with clients and relevant transaction parties, and meet legal obligations including customer due diligence and record-keeping.
We do not use client information for unrelated marketing without consent, and we do not sell client information.
Where necessary to progress a purchase, we may share relevant information with conveyancers, mortgage brokers and lenders, selling agents and their agencies, building or pest inspectors, and government or regulatory bodies where required by law.
We do not share client information with other third parties without consent, except where required or permitted by law.
Client information is stored in PropWisdom's Google Workspace environment with security controls including:
Staff must not download client identity or financial documents to personal devices or unmanaged storage.
General client records are kept only as long as reasonably necessary for the purpose for which they were collected, then securely deleted or de-identified where appropriate.
Identity verification and customer due diligence records collected for AML/CTF purposes are retained for the minimum period required by applicable law.
Clients may request access to, or correction of, the personal information PropWisdom holds about them by contacting kiran@propwisdom.com.au. Requests are responded to within a reasonable time, subject to applicable legal requirements.
If you believe your information has been mishandled, you can raise the matter with PropWisdom directly in the first instance. If unresolved, you may subsequently contact the Office of the Australian Information Commissioner (OAIC).
If PropWisdom becomes aware of unauthorised access to, or loss of, personal information that is likely to result in serious harm, it will assess and contain the breach and take notification steps required under the Notifiable Data Breaches scheme and applicable privacy law.
Personal information submitted through PropWisdom's website, including contact and Strategy Call forms, may be used to respond to enquiries and provide requested services. Please avoid submitting information that is not reasonably necessary for your enquiry unless specifically requested.
